Terms of Use

Last updated: 6 August 2026. Version 2.0.

These terms govern your access to and use of elicon.io and its subpages (the Site). Please read them. By accessing or using the Site you accept them. If you do not accept them, do not use the Site.

These terms apply to your use of this website. They do not govern any services Elicon may provide to you — those are governed by a separate signed agreement, as section 5 explains.

1. Who we are

The Site is operated by Elicon ("Elicon", "we", "us", "our), a software studio established in the Republic of Cyprus.

2. Definitions

  • Content — all text, graphics, illustrations, diagrams, code samples, case studies, layout, design, and other material made available on the Site.
  • You — the person accessing the Site, and any organisation on whose behalf you act.
  • Engagement — a services relationship between Elicon and a client, governed by a signed written agreement.

3. Acceptance and changes to these terms

By using the Site you agree to these terms as they stand at the time of your use. We may revise them at any time by posting an updated version, with a new version number and date. Changes take effect when published. It is your responsibility to review them; continued use after publication constitutes acceptance.

If you are accepting on behalf of an organisation, you warrant that you have authority to bind that organisation.

4. The Site is informational

The Site describes what Elicon does. Nothing on it constitutes:

  • an offer capable of acceptance, or a binding quotation;
  • professional advice of any kind — technical, legal, financial, security, tax or otherwise;
  • a warranty, guarantee or commitment as to outcomes, timelines or results;
  • a representation that any described service is available to you or suitable for your circumstances.

Do not act, or refrain from acting, in reliance on Content without obtaining advice appropriate to your situation.

4.1 Pricing information

Budget ranges, typical figures and programme bands published on the Site are indicative estimates for planning purposes only. They are not quotations, not offers, and not binding on Elicon. Actual price depends on scope, complexity and other factors established during discovery, and becomes binding only when set out in a signed agreement. Prices are stated in euro (EUR) and, unless expressly stated otherwise, exclude VAT and any other applicable taxes, duties or third-party costs.

4.2 Case studies and described work

Case studies on the Site describe work carried out by Elicon. Client names and identifying details are omitted or anonymised where confidentiality obligations apply, and figures describing outcomes are indicative of the engagements described. Past outcomes are not a promise, forecast, or guarantee of comparable results in any future engagement, which will depend on its own circumstances.

4.3 Availability of services

Descriptions of services on the Site do not guarantee that a service is currently available, that we have capacity, or that we will accept any particular engagement. We may decline any enquiry, and are not required to give reasons.

5. Enquiries create no engagement

Submitting the enquiry form, emailing us, booking or holding a call, or exchanging correspondence does not create a contract, a retainer, an engagement, or any obligation on either party to proceed.

An Engagement arises only when Elicon and the client have signed a written agreement setting out scope, deliverables, timeline and fees. Where that agreement conflicts with these terms, the signed agreement prevails in respect of the services it covers.

Do not send confidential information through the enquiry form. Information submitted through the Site is not treated as confidential and is not subject to any obligation of confidence unless and until a written confidentiality agreement is in place. We will of course handle your personal data as described in our Privacy Policy.

6. Acceptable use

You may access and use the Site for lawful purposes connected with evaluating or engaging Elicon's services. You must not:

  • use the Site in breach of any applicable law or regulation, or for any fraudulent or unlawful purpose;
  • attempt to gain unauthorised access to the Site, its server, or any network, system or data connected to it;
  • probe, scan or test the vulnerability of the Site or breach or circumvent any security or authentication measure, other than under a written authorisation from us to conduct such testing;
  • introduce or transmit any virus, worm, logic bomb, trojan or other material that is malicious or technologically harmful;
  • interfere with, disrupt, overload, or impair the operation of the Site — including by denial-of-service attack, excessive automated requests, or otherwise;
  • use automated systems to access, scrape, index or copy the Site or its Content, except for search-engine crawlers operating in accordance with our robots.txt file;
  • use the Site or its Content to train, fine-tune, evaluate or ground any machine learning or artificial intelligence system, or to build any dataset for such purposes, without our prior written consent;
  • reproduce, republish, resell, or systematically extract Content except as permitted in section 7;
  • submit false, misleading or impersonating information through the enquiry form, or use it to transmit unsolicited commercial communications;
  • remove, obscure or alter any copyright, trademark or other proprietary notice.

We may restrict or terminate your access to the Site at any time, without notice, where we reasonably consider that you have breached this section. Certain breaches of this section may constitute a criminal offence under Cyprus law, and we may report them to the appropriate authorities and cooperate with those authorities by disclosing your identity.

7. Intellectual property

All Content is owned by Elicon or its licensors and is protected by copyright, database rights, trademark law and other intellectual property rights. © 2026 Elicon. All rights reserved except as expressly granted here.

What you may do. You may view the Site, and print or download extracts for your own internal, non-commercial evaluation of our services. You may quote short extracts with attribution and a link to the source page.

What you may not do. You may not otherwise copy, adapt, translate, distribute, publicly display, commercially exploit or create derivative works from the Content without our prior written permission. No licence is granted by implication, estoppel or otherwise.

Trademarks. "Elicon", the Elicon logo, and our product names are our trademarks, whether registered or not. You may not use them without prior written permission, except in factual references to us that do not imply endorsement or affiliation. Third-party names, logos and trademarks appearing on the Site — including those of technologies we work with — belong to their respective owners and are used descriptively; their appearance does not imply endorsement of Elicon by those owners, or of them by us.

Open-source projects. Software we publish as open source is licensed under the terms accompanying it in its own repository — typically the MIT licence. Those licence terms govern that software and take precedence over this section in respect of it. Nothing in these terms restricts rights granted to you under an applicable open-source licence, and nothing in an open-source licence grants you rights in the Content of this Site.

Feedback. If you send us suggestions or feedback about the Site or our services, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it without restriction or obligation to you. Do not send us feedback you consider confidential.

8. Third-party links and resources

The Site contains links to third-party websites, repositories and resources. They are provided for information only. We do not control them, do not endorse them, and accept no responsibility for their content, availability, security or practices. Following an external link is at your own risk and subject to that site's own terms and privacy policy.

9. Availability, changes and interruption

We aim to keep the Site available, but we provide no guarantee of availability, uptime, or uninterrupted or error-free access. The Site is provided free of charge, and we may without liability:

  • change, suspend, restrict or withdraw all or part of the Site;
  • change, add to, or remove Content, including service descriptions and indicative pricing;
  • perform maintenance that makes the Site temporarily unavailable.

We are not obliged to keep Content up to date. Content is accurate to the best of our knowledge at the date of publication, and may become outdated afterwards.

10. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Site and all Content are provided "as is" and "as available", without warranty, condition or representation of any kind, whether express, implied or statutory. We specifically exclude, so far as the law permits, implied warranties of satisfactory quality, fitness for a particular purpose, accuracy, completeness, non-infringement, and any warranty that the Site will be secure, free of viruses, or free of interruption or error.

Nothing in this section limits any warranty expressly given in a signed Engagement agreement, which stands on its own terms.

11. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, your mandatory statutory rights are not affected by these terms.

Subject to the paragraph above, and to the fullest extent permitted by law:

  • We exclude all liability for loss or damage arising from use of, or inability to use, the Site, or from reliance on any Content.
  • We are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, business, contracts, anticipated savings, goodwill, data, or for business interruption, however arising and whether or not foreseeable.
  • We are not liable for loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your equipment, programs, data or other proprietary material as a result of your use of the Site or of material downloaded from it.
  • Our total aggregate liability arising out of or in connection with your use of the Site, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to one hundred euro (€100).

This section governs liability arising from use of the Site only. Liability arising under an Engagement is governed by the signed agreement for that Engagement.

12. Indemnity

You agree to indemnify and hold Elicon harmless against any claim, liability, loss, damage, cost or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the Site, or your infringement of any third-party right in connection with your use of the Site.

13. Privacy and data protection

Our processing of personal data in connection with the Site is described in our Privacy Policy, which forms part of these terms by reference.

14. Force majeure

We are not liable for any failure or delay in performing our obligations under these terms where that failure or delay results from causes beyond our reasonable control, including acts of God, war, civil unrest, industrial action, failure of utilities or telecommunications, failure of hosting or third-party service providers, cyber attack, or governmental action.

15. General

  • Severability. If any provision of these terms is found unlawful, void or unenforceable, that provision is severed and the remaining provisions continue in full force.
  • No waiver. A failure or delay by us in enforcing any provision is not a waiver of it, and does not prevent later enforcement.
  • Entire agreement. These terms, together with the Privacy Policy, constitute the entire agreement between you and us in relation to your use of the Site, and supersede any prior understanding on that subject.
  • Assignment. You may not assign or transfer your rights or obligations under these terms. We may assign ours to a successor to our business.
  • No third-party rights. No person other than you and Elicon has any right to enforce these terms.
  • Headings. Headings are for convenience and do not affect interpretation.

16. Governing law and jurisdiction

These terms, their subject matter and their formation (including any non-contractual disputes or claims) are governed by the laws of the Republic of Cyprus. You and we agree that the courts of the Republic of Cyprus have exclusive jurisdiction over any dispute arising out of or in connection with them.

If you are a consumer resident in the European Union, nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform, though we prefer that you contact us first so we can try to resolve matters directly.
